Jesse Ventura loses appeal

Jesse Ventura loses appeal to reinstate $1.8M verdict in defamation case
Quote:
The U.S. Supreme Court has turned away former Minnesota Gov. Jesse Ventura’s bid to reinstate a $1.8 million verdict in his defamation case against the estate of slain Navy SEAL and “American Sniper” author Chris Kyle.

The justices didn’t comment Monday in leaving intact a decision by the 8th U.S. Circuit Court of Appeals to upend the 2014 verdict.

Kyle’s autobiography was the basis for the 2014 film “American Sniper.”

Ventura, a former SEAL, took issue with Kyle’s claim that he punched Ventura at a California bar in 2006 for offensive comments about the SEALs.

A jury sided with Ventura in 2014.

But last June the three-judge 8th Circuit Court of Appeals panel tossed the bulk of the $1.8 million a jury awarded Ventura and sent back the rest for a new trial.

The appeals court did find there to be “extrinsic evidence” suggesting some of Kyle’s statements about the incident with Ventura were false, such as the claim that he hit Ventura (photos from the next day showed no apparent sign of injury) or that police witnessed the fight (local police had no record of the incident).

But the appeals court ruling did not delve into the truth of the overall story.

Instead, the appeals court focused on remarks from Ventura’s lawyers about an insurance policy that would pay for the damages. Those remarks poisoned the Kyle estate’s chances for a fair trial, the appeals court ruled.

The appeals court said there was never evidence proven during the trial that the policy actually existed as described or that it covered Kyle.

Talking about the policy, the court said, was a “deliberate strategic choice” by Ventura to sway jurors and win bigger damages “by referencing an impersonal deep-pocketed insurer.”

In the original 2014 verdict in favor of Ventura, jurors awarded him $500,000 for his defamation claim. The rest of the $1.8 million award came from an unjust enrichment claim, which the court of appeals dismissed the following year.

Ventura said last year that he had spent about $1 million fighting Kyle’s story.

The original 2014 trial was tightly contested, with jurors spending a week deadlocked. They reached a verdict only after both sides agreed to accept a split decision – the final count was 8-2 for Ventura.

The case could now return to Minnesota for a new trial.

Somewhere along the line Ventura lost his mind. I read his early books and largely agreed with most of it, but he went loopy somewhere. I could see his continued lawsuits if Kyle were alive to defend himself, but going after his estate which belongs to Kyles wife and kids is just asinine. In my mind he is Jesse The Jerk Ventura. He was great in Predator though.

For decades that was the movie I judged all others by. It was either not as good as Predator, nearly as good as Predator, or as good as Predator. That was my movie rating system.

There has never been a "better than Predator" movie. That was never a part of the rating system because it was pure folly.

I always thought that Jesse Ventura was in underwater demolitions and not a Navy SEAL. I know that some of the training is done alongside guys who will go on to become SEALs and that it is some of the more intensive training in the SEALs schedule, but it still isn't exactly the same thing. Not trying to diminish the training and service he went thru, but it does look like more sloppy journalism to me.

You know what? Just a loser trying to cash in on someone who did what he was supposed to do as a Military Joe! This is a case of extreme jealousy, I hope Ventura doesn't get a dime!

I don't fault Ventura, even though I don't agree with him. Many of our combat troops have ego issues, but hell, I WANT them to have ego issues. I WANT them to go into battle for my freedom and my safety thinking that they can dictate to the bad guy the way it's gonna be.

When two of our warriors duke it out, I know there's going to be hurt feelings. Kyle had an ego. Ventura had an ego. Pity is that they clashed, rather than being on the same side.

But at the end of the day, I am sure each felt they were right, and each felt they would fight for their point of view. And I applaud BOTH of them for that attitude, because when they were fighting for my country, I wanted both to use that attitude to win for me.

I am fairly certain that Jesse Ventura has lost his appeal to everyone by now.
Besides "He has no time to bleed" (Which is his poorly written book - that I paid good money for back in the day - I still feel a little miffed that I bought it now that this happened), just our time to use up all of our oxygen with his spewing forth of bad talk against a great fallen American hero that did his duty for America. Then he got his lairs - er I mean lawyers involved and sued Kyle's estate and therefore monies that were meant for Kyle's widowed wife and kids. Boo who - Now Jesse is complaining that it has cost him a million dollars defending himself. It's now a toss up between "Jane Fonda" or "Jesse Ventura" in my book.

My thought exactly!!! He acts like a big crybaby...not a SEAL. He should suck it up and let it go.

How much is Ventura's ego worth? Suing a widow - not a part of his original insult, is simply LOW.

He aint that old. 68 maybe

If by 58 you mean class number I guess that could be right, I don't know how that is structured, but he was born in '51 so obviously he didn't graduate from anything in '58.
